Conveyancing is the process by which the ownership to land is transferred, or ‘conveyed', from one person to another. It's generally recommended that you seek the services of a registered conveyancer or solicitor when buying or selling land, or when subdividing land.

Buying and Selling

If you're buying or selling land or property through a real estate or land agent, the agent will usually recommend a registered conveyancer or solicitor to handle your land dealing. The agent will forward the contract of sale to your appointed registered conveyancer or solicitor.

On receipt of the contract the registered conveyancer or solicitor will, among other things:

  • conduct searches to determine the state of the title
  • adjust rates and taxes
  • prepare the necessary documentation to affect the change of ownership
  • conduct the property 'settlement' process
  • register all related documentation with the Lands Titles Office.

Subdividing

If you're dealing with a land division, a conveyancer or solicitor will deal with the lodgement of the relevant registration documents leading to creation of a new title and registration of the division.
