Further Information

In order to divide land, a plan of division is required together with the required application, duplicate title and all necessary consents. In many instances to reach this stage takes months.

The following order of points are recommended for the procedure of land division.

Enquire with Your Local Council

Enquire at the local council Planning Area (either verbally or in writing) to discuss their planning requirements as to the proposed division eg. minimum allotment size, etc.

Obtaining Professional Assistance

Engage a Survey or Drafting Services firm who will act as agent for services by :-

  • initiating survey work over the subject land.
  • drafting a plan in accordance with Lands Titles Office (LTO) standards.
  • providing a breakdown on all related costs, eg Surveyor's/Drafting Services fees, SA Water fees, LTO fees, Development Assessment Commission (DAC) fees etc.
  • lodging a plan with DAC for planning approval. DAC will notify ETSA, Council, SA Water etc.

Conveyancer's or solicitor's services may be required to draft appropriate documentation (application) which is lodged in the LTO for the deposit of plan and issue of new certificates of title.

Approvals

After obtaining DAC approval, the final stage of the division process involves lodgement of the plan and application in the LTO by either the Drafting Services firm, Surveyor or Conveyancer. Financial institutions usually require that the plan be DEPOSITED (ie All documentation and plan requirements are approved by LTO) before settlements can occur. For this reason it is suggested that applicants regularly review the plan progress with their agent so that settlements may be based on realistic time frames.

  • Note: a Survey firm, Drafting Services firm or Conveyancer may include the term 'Property Development Consultant' within their title.
  • The division of land from one allotment into two can cost several thousand dollars and you are advised to seek professional assistance for determining the costs involved.
