Mortgages are made 'Common' usually where the same mortgage is registered over multiple Certificates of Title and this prevents delays in the examination and registration of other documents. Requests to make a mortgage 'Common' can be made by producing a written request together with the duplicate mortgage, at the Lands Titles Office (LTO). There is no additional fee for this service.

The duplicate mortgage is retained by the LTO until a request is made to remove it from the Common Mortgage List. This is done by producing further written instructions at which time the number will be removed from the list and the duplicate returned to the mortgagee.

  • A mortgage will only be made 'Common' when it is registered over a minimum of 10 Certificates of Title.
  • The LTO can request the instrument be made 'Common' to facilitate registration backlogs. While the majority of documents on the list are mortgages, other instruments such as encumbrances or leases can also be made 'Common'.
  • If a mortgage is currently over less than 10 titles but a subdivision application has been lodged that will result in 10 or more titles issuing with this mortgage, then the 'Common' request will be granted.
