Lodgement Notes
Purpose:
Cessation of Lien can be lodged by the Registered Proprietor to remove a lien:
-
where no action has commenced within 14 calendar days of the lien being lodged in the LTO
- if the action in the court for enforcement fails
- where money has been lodged to satisfy the lien in the LTO or the Court
The amount claimed in respect of the Lien may be lodged either in court or in the Lands Titles Office (Worker's Lien Trust account) to prevent an action by the lienor. Money paid into the Worker's Lien Trust account does not accrue interest. In these circumstances a
letter of request (addressed to the Registrar-General) is to be forwarded with the document to satisfy Section 16 of the Workers Lien Act 1893 together with the appropriate cheque.
The Lienor may remove the Lien by the lodgement of a Withdrawal of Lien.
