Lodgement Notes
Purpose:
A Foreclosure Application (FA) is lodged by the mortgagee and once passed the Registrar-General will prepare the Foreclosure Order (FO) document.
A Foreclosure Application may be lodged as regards a subsidiary interest (e.g. mortgage of mortgage, lease, agreement). In this circumstance, the Foreclosure Application (FA) after being passed will be prepared by the Registrar-General as a Foreclosure Order (FO2) document. A separate application must be made for each mortgage except where two or more mortgages are to the same mortgagee.
A Foreclosure Order as regards an estate in fee simple will extinguish all subsequent interests, (except a lease which on its registration was consented to by the mortgagee) and the mortgagee will become the registered proprietor.
