Purpose:
A Lease is an agreement whereby the owner of a real property (lessor) gives the right of possession (exclusive use) to another (lessee) for a specified period of time (term) and for a specified consideration (rent). Lease may be lodged over a Certificate of Title or Crown Lease. There is no requirement to register a Lease where the term is less than for one year.

If the land being leased is portion of a CT or CL, the leased land must be identified precisely by reference to the appropriate plan.

Where contiguous allotments of land are held by different registered proprietors in separate certificates of title are to be leased to one lessee, clients should prepare a separate Lease document for each individual lease to be granted. Should a document be prepared disclosing multiple lessors (each in ownership of a separate title) then it will be assigned one number per proprietorship and charged one registration fee per number. A lease document must be lodged in duplicate or triplicate.

Note:The lease will appear on a register search of a TATS title for a period of 90 days after expiration of the lease.
