Lodgement Notes
Purpose:
Grant of Easement / Profit A Prendre'. Form TG is designed for use when easements in gross are being created or an easement or right is to be granted to other land .
Where land is transferred and an easement is also to be created the correct form is a form T2.
Where there is one grantor granting an easement or right of way to contiguous allotments (or Sections) of land held by different registered proprietors in separate certificates of title, separate Form TG's (one for each dominant proprietor) should be used. (One grantor with multiple grantees.)
Similarly, where contiguous allotments (or Sections) of land are held by different registered proprietors in separate certificates of title and are granting an easement or right of way to one grantee, separate Form TG's (one for each servient proprietor) should be used. (Multiple grantors with one grantee.)
If a Form TG is lodged disclosing either:One grantor with multiple grantees orMultiple grantors with one grantee
then it will be assigned one number per proprietorship and charged one registration fee per dealing.
Fees:
Generally, the Registration fee is assessed (at the date of sale) on either the consideration for the transfer or the value of the interest being transferred as assessed by the Commissioner of State Taxation. WHICHEVER IS GREATER. The Registration fee is calculated exclusive of GST and plant or equipment.
